Data is collected and processed by INDUSTRY LINK SRL, which is a legal Romanian company, based in Bucharest, Sos.   1. What personal data do we collect from you, why and how do we process it?

To carry out our current activity, through the website, you can fill out various online forms, such as:

  • In the “Contact” section , you can communicate with us and request any information and clarifications related to us and our core business. When you communicate with us, we process your email address and any other data you provide in the content of the message, in order to appropriately respond to your requests or questions.
  • By completing the online form in the “ Newsletter” section , we collect your email address, which we use to inform you about our activity and the events we organize and that you may be interested in. In addition, to be sure of your intention to subscribe, we verify this through an additional confirmation email.
  • In order to promote our activity and/or our clients on our website or on our social media accounts, we compile a portfolio of photo/video images and testimonials. To achieve this purpose, we process your images and the personal data you provide when writing a testimonial: Name and surname, academic degree, position, place of employment, etc.
  • To promote our activity and to be in contact with you, we have created presentation pages on social media platforms ( Facebook , X, Instagram) and professional platforms ( LinkedIn ) where you can contact us through messages, likes, comments. When you communicate with us, we process your online identity and any other data you provide in the content of the message, in order to respond appropriately to your requests or questions.
  • To participate in the events organized by us and purchase the participation ticket, we process your name, first name, the company you represent , and contact details (address, email, phone number ).

 

  1. In what purpose and how we process data collected online, by phone or sent directly by you ?

We process your personal data for:

  • Your registration and participation in events organized by us or for our partners.
  • Sending newsletters with information regarding events organized by us or for our partners.
  • Creating a portfolio of images/testimonials to promote our work to other interested people.

 

  1. Who is responsible for collecting and processing your personal data?

INDUSTRY LINK SRL is the operator responsible for the collection and processing of personal data through the website https://www.industrylink.eu/ .

 

  1. From whom and how do we collect your personal data?

We collect your personal data directly from you, either through the forms you fill out on the website, or through the emails you send us or through any other means of remote communication (mail, express courier, etc.), either by telephone or directly at our office.

For events organized jointly with other partners, we may receive your personal data from them.

 

  1. What are the legal grounds we rely on to process your personal data?

 

7.1. For your registration and participation in events organized by us or for our partners, your personal data is processed based on art. 6, paragraph 1, letter b) of Regulation 679/2016 (execution of contract ).

7.2. For the transmission of newsletters with information regarding events organized by us or for our clients, or about recruitment competitions organized by us and in which you may be interested, your personal data is processed based on art. 6, paragraph 1, letter a) of Regulation 679/2016 ( consent ).

7.3. In order to create a portfolio of images/testimonials to promote our activity to other interested persons, your personal data is processed based on art. 6, paragraph 1, letter a) of Regulation 679/2016 ( consent ).

7.4. For communication with you through the contact section or any other forms for sending messages to us, your personal data is processed based on art. 6, paragraph 1, letter b) of Regulation 679/2016 (request/contract) but also art. 6, paragraph 1, letter f (legitimate interest).

 

 

  1. Do we process personal data for profiling or automated decision-making?

We do not process your personal data to create a profile for you, nor do we use a solely automated process without human intervention to make decisions about you.

 

  1. How long do we keep your personal data?

We store personal data under the applicable legislation for each purpose of processing and limit it to what is strictly and legally necessary.

9.1 We store the personal data processed for your registration and participation in events organized by us or for our partners for 120 months from the last interaction with you.

9.2. Personal data processed for the transmission of newsletters with information regarding events organized by us or for our clients, or about recruitment contests organized by us and in which you may be interested, are stored for the period strictly necessary to achieve the purposes for which they were collected (e.g. 120 months from the last interaction) or until your consent is withdrawn.

9.3. Personal data processed for the creation of the image/testimonial portfolio to promote our activity to other interested persons is stored for the period strictly necessary to achieve the purposes for which it was collected or until your consent is withdrawn.

9.4. Personal data processed for financial-accounting and anti-money laundering purposes, if the services provided by us involve the payment of a fee to us, are stored in accordance with the provisions of the legislation applicable to financial-accounting activity and that regarding the fight against money laundering.

Personal data that has become useless or has expired, under the law, is deleted/irreversibly destroyed from any databases and from any storage/archiving media used for personal data.

Personal data processed on the basis of your consent shall be irreversibly deleted/destroyed from any databases and from any personal data storage/archiving media used as soon as you have submitted a request to withdraw consent under the terms of art. 7, para. 3 of the GDPR: “

 

(3) The data subject shall have the right to withdraw his or her consent at any time. Withdrawal of consent shall not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. Before giving consent, the data subject shall be informed of this. Withdrawing consent is as easy as giving it.

 

By way of exception, personal data that has become useless or has reached its maturity, under the law, may be stored for longer periods of time if they are necessary for the defense of a right in court of the data subject or of us.

 

  1. To whom do we disclose/disclose your personal data?

Depending on the purposes for which we process your personal data, we disclose data to state institutions and bodies, under the law, or to judicial/criminal investigation bodies, under the law.

We may also share your data with our company’s processors (IT, newsletter, database storage, etc.).

To process your personal data safely for your fundamental rights and freedoms, we have taken appropriate technical and organizational measures to protect personal data, including, but not limited to:

  • All our collaborators sign a confidentiality agreement regarding the protection of personal data processed by them;
  • All collaborators are properly trained on the security measures implemented by us and which they must comply with to protect personal data;
  • We only use external services offered by providers who demonstrate that they ensure a high level of security of personal data processed on our behalf;
  • We implement technical and organizational security measures for the physical protection of the locations where we process personal data and the devices we use in our current activity.

All technical and organizational measures implemented by us are intended to protect your personal data against unauthorized or unlawful processing and against accidental loss, destruction or damage.

 

  1. What are the rights? Are you guaranteed by GDPR ?

In order to comply with the provisions of Regulation 679/2016, we guarantee the following rights:

  1. You have the right to withdraw your consent to the processing of your personal data at any time. The withdrawal of consent does not affect the lawfulness of the processing of your personal data carried out before its withdrawal. The withdrawal of consent is as easy as granting it, by sending an email to contact@industrylink.eu , or at our headquarters.

 

  1. You have the right to receive access to your personal data that we process, and we provide you with confirmation as to whether or not we are processing your personal data, and, if so, we provide you with all the mandatory information provided for in Article 15 of the GDPR, as well as a copy of these data, if you request it, in the format requested by you and via the communication channel specified by you in the request.

 

  1. You have the right to obtain from us the rectification of inaccurate personal data concerning you without undue delay, as well as the completion of incomplete personal data, including by providing a supplementary statement. We must communicate the rectification of your personal data to the recipients of your personal data (if any).

 

  1. You have the right to request the deletion of personal data that we process.

We are obliged to delete your personal data and will do so without undue delay if the following conditions set out in Article 17, paragraphs 1 and 2 of the GDPR are met:

  • personal data is no longer necessary​ for achieving goals for which they were collected or processed ;
  • you withdraw consent based on which the processing takes place and there is no no other legal basis for processing ;
  • youoppose processing for reasons related to the particular situation in which you areand there are no legitimate reasons to prevail (art. 21, par . 1 GDPR) or you oppose processing for direct marketing purposes (art. 21, para . 2 GDPR);
  • your personal data were​ processed in an illegal manner ;
  • your personal data must be erased for compliance with a legal obligation to which we are subject under Union law or national law to which we are subject
  • the personal data were collected in connection with the provision of information society services directly to a child

 

 

In the event where we have made personal data public and we are compelled to erase them, taking into account available technology and the cost of implementation, we will take reasonable steps, including technical measures, to inform the controllers processing your personal data that you have requested the erasure by these controllers of any links to those data or of any copies or reproductions of those personal data.

We will refuse deleting your personal​ data as per the following terms expressed by art. 17 , paragraph 2 GDPR:

  • if the processing of personal data is necessary for the exercise of the right to freedom of expression and information;
  • if the processing of personal data is necessary for compliance with a legal obligation requiring processing under the European Union or national law to which we are subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in us, where applicable;
  • if the processing of personal data is necessary for reasons of public interest in the area of public health, in accordance with Article 9(2)(h) and (i) and Article 9(3) GDPR;
  • if the processing of personal data is necessary for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with Article 89(1), to the extent that exercising your right to erasure of personal data is likely to render impossible or seriously impair the achievement of the objectives of that processing;
  • if the processing of personal data is necessary for the establishment, exercise or defense of a right in court.

 

  1. You have the right to request the restriction of processed data in the following cases:
  • you contest the accuracy of the data and we will restrict its processing for a period that allows us to verify the accuracy of the data;
  • the processing is unlawful and you oppose the erasure of your personal data, requesting instead the restriction of their use;
  • we no longer need the personal data for the purpose of processing, but you request it from us for the establishment, exercise or defense of a right in court;
  • you object to the processing in accordance with Art. 21 para. 1 GDPR, for the period during which we verify whether our legitimate rights override your rights.

If processing has been restricted on the grounds set out above, your personal data may, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

If you have obtained restriction of processing from us, you will be informed by us before the restriction of processing is lifted.

  1. You have the right to data portability . You may request at any time to receive the personal data concerning you which you have provided to us in a structured, commonly used and machine-readable format and you have the right to transmit these data to another controller without hindrance from us, where:
  • the processing is based on consent;
  • the processing is based on a contract concluded between us and you.
  • processing is carried out by automatic means .

 

In exercising your right to data portability, you have the right to have your personal data transmitted directly from one controller to another where this is technically feasible.

The exercise of your right to data portability is without prejudice to Article 17 GDPR (right to erasure of personal data), as that right does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Your right to data portability does not affect the rights and freedoms of others.

 

  1. You have the right to object, at any time, for reasons relating to your particular situation, to the processing of personal data carried out pursuant to art. 6, para. 1, letter e) or f) of the GDPR, including creating profiles based on​ those provisions .

 

We will immediately stop processing your personal data if you object to the processing, unless we demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims. Where the processing of personal data is for the purpose of direct marketing, you have the right to object at any time to the processing of your personal data for this purpose, including profiling, to the extent that it is related to that direct marketing, and we will immediately stop processing your personal data for direct marketing purposes.

In the context of using information society services, you may exercise the right to object to the processing of your personal data by automated means using technical specifications.

  • Where we process your personal data for scientific or historical research purposes or for statistical purposes, you may, on grounds relating to your particular situation, object to the processing of personal data concerning you, unless the processing is necessary for the performance of a task carried out for reasons of public interest.
  1. You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you

Your right not to be subject to a decision based solely on automated processing does not apply if the decision

 

  1. is necessary for the conclusion or performance of a contract between you and us;
  2. is authorised by Union or national law to which we are subject and which also lays down suitable measures to safeguard your rights, freedoms and legitimate interests;
  3. if it is based on your explicit consent.

In the cases referred to in letters (a) and (c), we implement appropriate measures to protect your rights, freedoms and legitimate interests and guarantee you at least the right to obtain human intervention on our part to express your point of view and contest the decision.
